These Terms of Service ("Terms") govern your use of the websites, applications, coaching services, and related products operated by Fireseeds North Infrastructure Corporation, including all products developed by its Fireseeds North Fitness Labs department ("Fireseeds," "we," "our," or "us").

By creating an account or using our services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or have the permission of a parent or legal guardian if you are under the age required by the laws of your jurisdiction.

You are responsible for maintaining accurate account information and for all activity occurring under your account.

2. Our Services

Our services may include:

  • AI coaching

  • Human coaching

  • Team-based accountability

  • Fitness tracking

  • Nutrition tracking

  • Habit tracking

  • Challenges

  • Educational content

  • Community features

  • Other wellness tools

Our services may change at any time as we continue developing the platform.

3. Medical Disclaimer

Our services are provided for educational, informational, motivational, and accountability purposes only.

We are not doctors, medical providers, dietitians, physical therapists, psychologists, or other licensed healthcare professionals unless explicitly stated.

Nothing within our services constitutes medical advice or establishes a healthcare provider-patient relationship.

Always seek the advice of your physician or another qualified healthcare professional regarding any medical condition.

4. Consult Your Healthcare Provider

Before beginning any exercise, nutrition, weight-loss, strength training, endurance training, or lifestyle program, you should consult your physician or other qualified healthcare professional, particularly if you:

  • have heart disease or cardiovascular risk factors

  • have diabetes

  • have high blood pressure

  • have respiratory disease

  • are pregnant

  • have recently undergone surgery

  • have musculoskeletal injuries

  • have neurological conditions

  • are taking medications that may affect exercise tolerance

  • have any condition that could make exercise unsafe

If you experience chest pain, dizziness, fainting, unusual shortness of breath, severe pain, or any other concerning symptoms, discontinue participation immediately and seek medical attention.

5. Assumption of Risk

Physical exercise, strength training, cardiovascular exercise, weight loss, nutrition changes, and other health-related activities involve inherent risks.

These risks include, but are not limited to:

  • muscle strains

  • sprains

  • fractures

  • dehydration

  • illness

  • allergic reactions

  • falls

  • equipment failure

  • permanent disability

  • death

You voluntarily assume all risks associated with participating in our programs.

6. Release of Liability

To the maximum extent permitted by applicable law, you agree that Fireseeds North Infrastructure Corporation and its directors, officers, employees, contractors, volunteers, coaches, customer captains, virtual assistants, affiliates, successors, and licensors shall not be liable for any injury, illness, disability, death, property damage, financial loss, emotional distress, or other damages arising from or relating to:

  • participation in our programs

  • reliance upon our content

  • coaching recommendations

  • AI-generated responses

  • community interactions

  • technical failures

  • inaccurate information

  • interruptions of service

  • user-generated content

  • third-party services

Participation is entirely voluntary.

7. No Guarantees

We make no guarantee regarding:

  • weight loss

  • muscle gain

  • athletic performance

  • disease prevention

  • longevity

  • habit formation

  • consistency

  • motivation

  • health improvements

  • competition results

Individual outcomes vary significantly.

8. Community Conduct

You agree to:

  • treat others respectfully

  • avoid harassment

  • avoid illegal activity

  • avoid impersonating others

  • avoid uploading malicious software

  • avoid attempting unauthorized access to our systems

We may suspend or terminate accounts for violations.

9. Privacy and Data

Your use of our services is also governed by our Privacy Policy.

You acknowledge that our platform currently relies upon third-party software, AI systems, spreadsheets, communication platforms, contractors, and human support personnel.

Although we take reasonable steps appropriate for an early-stage platform, we cannot guarantee complete privacy or security.

You accept the inherent risks associated with electronic storage and transmission of information.

10. Third-Party Services

Our platform may integrate with third-party providers including payment processors, AI providers, cloud hosting providers, communication platforms, analytics providers, and other software vendors.

We are not responsible for the operation, availability, security, or policies of those third parties.

11. Payments and Subscriptions

Subscription fees are charged in accordance with the pricing presented at the time of purchase.

Payments are processed by Stripe or another authorized payment processor.

Unless required by law or otherwise stated, subscription fees are non-refundable.

12. Intellectual Property

All software, content, graphics, branding, logos, coaching systems, methodologies, prompts, educational materials, and other intellectual property remain the property of Fireseeds or its licensors.

You may not reproduce, distribute, modify, reverse engineer, or commercially exploit our content without written permission.

13. Changes to the Service

We may add, remove, modify, suspend, or discontinue any feature at any time without prior notice.

14. Termination

We may suspend or terminate your account at any time for violations of these Terms or for conduct that we reasonably believe is harmful to our users or our business.

You may stop using the service at any time.

15. Limitation of Liability

To the fullest extent permitted by law, the total liability of Fireseeds North Infrastructure Corporation arising out of or relating to these Terms or the use of our services shall not exceed the amount you paid us during the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability. Where prohibited, these limitations apply only to the maximum extent permitted by law.

16. Indemnification

You agree to indemnify and hold harmless Fireseeds North Infrastructure Corporation, its affiliates, directors, officers, employees, contractors, volunteers, customer captains, licensors, successors, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from:

  • your use of the services;

  • your violation of these Terms;

  • your violation of any law or the rights of another person; or

  • content you submit or share through the platform.

17. Governing Law

These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein, unless otherwise required by applicable consumer protection legislation.

18. Changes to These Terms

We may modify these Terms from time to time.

Continued use of our services after updated Terms become effective constitutes acceptance of the revised Terms.
